Terms and Conditions

Introduction

These Terms and Conditions ("Terms") govern the use of community peer support services provided by Litigant Support New Zealand Limited, trading as "Good Dad New Zealand" and "Good Mum New Zealand" ("we", "us", "our") to support litigants in the Family Court of New Zealand.

 

By accessing or using our services, including but not limited to;

  • general enquiries and discussions

  • ongoing 1:1 peer support

  • and McKenzie Friend preparation and in-court support,

you ("supportee", "user", "you", "your") agree to be bound by the terms as follows,

  1. Purpose of Services – Our services are intended to provide general support, guidance, and encouragement to litigants in the Family Court of New Zealand. Our services are not intended to replace professional legal or therapeutic advice. We do not provide legal or therapeutic services, and our services should not be relied upon for such purposes.

  2. No Legal or Therapeutic Advice –  Our services are not to be considered legal or therapeutic advice. Supportees are responsible for seeking independent professional advice from a qualified legal or therapeutic practitioner for their specific needs and circumstances.

  3. No Attorney-Client or Therapist-Client Relationship – Your use of our services does not create an attorney-client or therapist-client relationship between you and Litigant Support New Zealand Limited or any of its representatives. Any information you provide to us is not protected by attorney-client or therapist-client privilege.

  4. Limitation of Liability – In no event will Litigant Support New Zealand Limited or any of its representatives be liable for any damages, including without limitation, direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of our services, whether based on contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

  5. No Warranty – Our services are provided "as is" and “when available” without any warranty of any kind, express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

  6. Indemnification – You agree to indemnify, defend, and hold harmless Litigant Support New Zealand Limited and its representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising out of or in connection with your use of our services, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

  7. Governing Law and Jurisdiction – These Terms shall be governed by and construed in accordance with the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the courts of New Zealand in relation to any dispute arising out of or in connection with these Terms.

  8. Severability – If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect and shall be enforceable to the fullest extent permitted by law.

  9. Amendments – Litigant Support New Zealand Limited reserves the right to amend these Terms at any time and without notice. Your continued use of our services following any such amendment constitutes your acceptance of the amended Terms.

  10. Voluntary Contributions – We welcome and appreciate voluntary contributions made by community members to support our services. Contributions are not to be considered as payment for any kind of service. All contributions made to Litigant Support New Zealand Limited are voluntary and do not entitle the contributor to any specific services, privileges, claims or benefits.

  11. No Fees or Charges – Litigant Support New Zealand Limited does not quote, charge, or set any prescribed fees for our services. We operate on a voluntary basis, and any contributions made by community members are intended to support the continuation and improvement of our services.

  12. No Refunds – All contributions made to Litigant Support New Zealand Limited are non-refundable. By making a contribution, you acknowledge that your contribution is a voluntary donation and not a payment for any specific service.

  13. Use of Contributions – Contributions made to Litigant Support New Zealand Limited will be used at our discretion to support the provision and development of our community peer support services. This may include, but is not limited to, covering operational expenses, funding training or resources, or promoting our services to a wider audience.

  14. Contributor Acknowledgment – By making a contribution, you acknowledge and agree that your contribution is made voluntarily and that you do not expect any specific services, benefits, or privileges in return.

  15. Tax Implications – It is your responsibility to understand and comply with any applicable tax laws and regulations in relation to your contribution. Litigant Support New Zealand Limited does not provide tax advice, and we recommend consulting with a tax professional if you have any questions about the tax implications of your contribution.

  16. Entire Agreement These Terms constitute the entire agreement between you and Litigant Support New Zealand Limited regarding the use of our services and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter hereof.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
